Judge Narrows EEOC Race Bias Suit Against Kaplan

Law360, New York (May 11, 2011, 3:01 PM EDT) -- An Ohio federal judge on Tuesday narrowed the liability period for the U.S. Equal Employment Opportunity Commission's lawsuit alleging Kaplan Higher Education Inc.'s rejection of job candidates based on their credit histories has a disparate impact on black job seekers.

U.S. District Judge Patricia A. Gaughan granted Kaplan's motion for partial dismissal of the EEOC's discrimination claim, ruling that any challenges to employment decisions Kaplan made more than 300 days before an employee filed an EEOC charge are time-barred.
