6th Circ. Shuts Door On BP Pipeline Contamination Row

Law360, New York (May 12, 2011, 7:04 PM EDT) -- The Sixth Circuit on Thursday affirmed the dismissal of a couple's toxic tort suit alleging that they were exposed to benzene and other harmful contaminants from an underground pipeline that BP Oil Pipeline Inc. operated more than 40 years ago.

A three-judge panel found that an Ohio federal court did not err in granting summary judgment to BP in Sue and Ray Pluck's suit claiming strict liability and negligence related to alleged benzene exposure, after excluding their specific-causation expert as unreliable due to “significant methodological flaws.”...
