Green Group Fights Endangered Species MDL Settlement

Law360, New York (May 16, 2011, 6:29 PM EDT) -- The Center for Biological Diversity asked a Washington federal judge on Monday to postpone approving the government's settlement with WildEarth Guardians over sprawling Endangered Species Act litigation, deeming the deal “an illusory agreement” that undermines the ESA.

The Center, which is a plaintiff in a complaint consolidated with the 12 suits being settled, asked to intervene or to be an amicus party in WildEarth's cases so that it could fight the settlement with the U.S. Fish and Wildlife Service, and also asked for a stay on...
