Mass. Brewer Bill Would Curb Competition, FTC Says

Law360, New York (May 19, 2011, 2:52 PM EDT) -- Federal Trade Commission staff on Tuesday advised against the passage of a Massachusetts law imposing new restrictions on tie-ups between beer suppliers, arguing it would limit competition and raise costs in the industry.

In a letter responding to a query from Massachusetts state Rep. Alice Peisch, the commission staff recommended the legislature drop proposed Massachusetts House Bill 1871, which is designed to add new administrative obligations when one malt beverage supplier acquires another and seeks to terminate any wholesaler agreements.
