7th Circ. Upholds Black Lung Benefits Act Amendment

Law360, New York (May 19, 2011, 6:45 PM EDT) -- The Seventh Circuit on Thursday backed the constitutionality of a little-known provision in the health care reform law that helps those seeking benefits under the Black Lung Benefits Act.

A three-judge panel supported the provision while granting a second chance at survivor's benefits to Jacqueline Keene, a widow of a coal miner who formerly worked for Consolidation Coal Co. The Benefits Review Board had rejected claims brought by Keene and her late husband, ruling they had not shown Keene's husband suffered from black lung disease....
