DOE Escapes Suit To Block $4B Nuclear Facility

Law360, New York (May 23, 2011, 7:00 PM EDT) -- A New Mexico federal judge ruled Monday that an anti-nuclear advocacy group had prematurely brought a suit seeking to block the U.S. Department of Energy's planned construction of a local $4 billion nuclear research facility.

In dismissing the complaint in its entirety based on the doctrine of prudential mootness, U.S. District Judge Judith C.
