SEC Seeks Retrial For Isilon Executive's Fraud Suit

Law360, New York (May 23, 2011, 6:45 PM EDT) -- The U.S. Securities and Exchange Commission wants another crack at a former executive of Isilon Systems Inc. accused of faking earnings whose trial ended in a hung jury, the regulator said Thursday in a federal court filing.

The SEC wants to retry Stuart W. Fuhlendorf, a former chief financial officer of the Seattle-based data storage device company, after the jury told the court May 11 it was deadlocked, resulting in a mistrial. The jury deliberated for 21 days, beginning April 11, before declaring a hung jury,...
