Apotex Infringed Alcon's Eye Drop Patent: Judge

Law360, New York (May 24, 2011, 7:26 PM EDT) -- An Indiana federal judge ruled Monday that Apotex Inc.'s efforts to market a generic version of the popular eye allergy treatment Patanol infringed Alcon Inc.'s patent for the drug.

Following a bench trial, U.S. District Judge Richard L. Young determined that Alcon had proven the Apotex's generic equivalent of the company's topical ocular allergy medication infringed U.S. Patent Number 5,641,805. The judge further found Apotex had failed to prove the patent was invalid or unenforceable.
