3rd Circ. Nixes Chevron's Discovery Win In Ecuador Fight

Law360, New York (May 25, 2011, 7:46 PM EDT) -- The Third Circuit ruled Wednesday that attorney meetings in the film “Crude” did not waive the indigenous plaintiffs' attorney-client privilege, the latest in an environmental fight that led to an $18.1 billion judgment against Chevron Corp. in Ecuador.

The plaintiffs in the 17-year-old underlying case alleged that Texaco Petroleum Co., now owned by Chevron, polluted vast stretches of the rainforest in Ecuador, causing rampant environmental and health problems for indigenous residents. Chevron continues to battle in the U.S. against the Ecuadorean jury's findings and hefty award....
