3rd Circ. Springs Ex-Rite Aid GC From Prison

Law360, New York (May 26, 2011, 10:02 PM EDT) -- The Third Circuit ordered the release of the former general counsel of Rite Aid Corp. from federal prison Thursday, saying the trial judge in his accounting fraud case did not adequately explain the sentence of more than seven years.

Franklin C. Brown, now 83 and suffering from serious cardiac problems, will be freed on bail from a North Carolina medium security prison while his trial judge takes a third shot at coming up with a sentence that passes appellate muster. The decision is not legally precedential,...
