FTC's Attempt To Block Gas Acquisition Dismissed

Law360 (May 15, 2007, 12:00 AM EDT) -- A federal judge on Monday dismissed the U.S. Federal Trade Commission’s request for a preliminary injunction blocking Equitable Resources Inc.’s proposed acquisition of a Pennsylvania natural gas company.

Judge Arthur J. Schwab of the U.S. District Court for the Western District of Pennsylvania ruled that Pennsylvania’s Public Utility Commission, which approved Equitable’s acquisition of Dominion Resources Inc. subsidiary the Peoples Natural Gas Co., had the jurisdiction to approve the deal despite the FTC’s attempts to circumvent the state regulator.
