EU Court Rejects Black & Decker’s Trademarks

Law360 (May 15, 2007, 12:00 AM EDT) -- Europe’s second-highest court has upheld a lower court ruling that rejected Black & Decker Corp.’s bid to trademark the black and yellow design on its power tools.

In a decision reached Tuesday, the European Court of First Instance said the Office for Harmonisation in the Internal Market’s board of appeal was correct to deny Black & Decker’s application for 13 marks.
