Law360, New York (May 27, 2011, 7:56 PM EDT) -- A federal judge in North Carolina on Friday denied a request for a preliminary injunction by BASF Agro BV and Bayer SAS in a suit accusing Makhteshim Agan of North America Inc. of infringing patents for a method of using anti-termite pesticide.
In deciding the motion, U.S. District Judge William L. Osteen Jr. construed a key term of the asserted patents and concluded that Makhteshim's product did not meet the limitations of the claim.
