High Court Won't Hear Novartis Appeal Of Zometa Suit

Law360, New York (May 31, 2011, 5:03 PM EDT) -- The U.S. Supreme Court refused Tuesday to take up Novartis Pharmaceuticals Corp.’s appeal of a state court ruling in a suit over its osteoporosis treatment drug Zometa, leaving the company on the hook for $2.6 million.

The high court denied Novartis’ petition for writ of certiorari in the case in which plaintiff Peggy Stevens alleged she suffered from osteonecrosis of the jaw after taking Zometa, which is intended to increase bone strength in cancer patients.
