Judge Won't Nix US Airways Suit Over AWA Merger Row

Law360, New York (June 1, 2011, 9:39 PM EDT) -- A federal judge in Arizona refused Tuesday to toss US Airways Inc.'s suit asking the court to absolve the airline of liability in a dispute between warring pilot factions that stems from US Airways' purchase of America West Airlines.

U.S. District Judge Roslyn O. Silver ruled that US Airways' complaint for declaratory relief was ripe and denied the US Airline Pilots Association's request to dismiss the claims against it and a group of former AWA pilots.
