Asarco Hits EPA With 2nd FOIA Suit Over Superfund Site

Law360, New York (June 6, 2011, 1:19 PM EDT) -- Mining company Asarco Inc. on Friday reopened a battle with the U.S. Environmental Protection Agency over $219.5 million it paid to settle allegations related to a Nebraska Superfund site, claiming the agency destroyed records that would have cleared its name.

Asarco filed its second Freedom of Information Act suit over the documents in D.C. federal court, arguing that the court had relied on false affidavits by an EPA official when it dismissed the company's earlier lawsuit.
