Merge Insurer Fights Coverage Of Entire 3M Fee Award

Law360, New York (June 7, 2011, 3:18 PM EDT) -- Carolina Casualty Insurance Co. sued Merge Healthcare Inc. in Illinois federal court Monday seeking to avoid covering all of a $3.15 million award for attorneys' fees in underlying securities litigation involving a recent acquisition target of the company.

In the underlying case in Massachusetts state court, shareholders of Amicas Inc. challenged the adequacy of that company's disclosures over its proposed acquisition by Thomas Bravo LLC, as well as the process by which proposals had been considered by the Amicas board.
