Medical Food Makers Settle False Advertising Suit

Law360, New York (June 8, 2011, 8:18 PM EDT) -- Brookstone Pharmaceuticals LLC on Tuesday settled a false advertising and unfair competition suit that alleged the drugmaker had falsely claimed to be selling a generic medical food with the same benefits as one developed by Pamlab LLC.

U.S. District Judge Judge Mary Ann Vial Lemmon of the Eastern District of Louisiana dismissed the case without prejudice based on an agreement reached between Brookstone and co-defendant Arizona Nutritional Supplements Inc. and Pamlab and co-plaintiff Metabolite Laboratories Inc.

Pamlab and Metabolite filed the original complaint in November 2009 over a product they said was falsely portrayed as a generic version of Pemlab's folate...
