Polyflow Can't Exclude Damages In La. Pipeline Suit

Law360, New York (June 9, 2011, 7:05 PM EDT) -- A Louisiana federal judge on Thursday denied Polyflow Inc.'s bid to bar damages from allegedly “unlawful production revenues” in a breach of implied warranty and product liability lawsuit over a natural gas line that ruptured soon after construction finished.

U.S. District Judge Ivan L.R. Lemelle rejected the request by Polyflow, which manufactured the Thermoflex pipe used in the line, for partial summary judgment on the plaintiffs' claims for damages arising from the sale of gas prior to Dec. 22, 2009.
