Lloyd's Off Hook For Coal Pollution Coverage: 6th Circ.

Law360, New York (June 10, 2011, 5:19 PM EDT) -- The Sixth Circuit affirmed Thursday that a pollution exclusion in NFC Mining Inc.'s insurance policy from Lloyd's of London bars coverage for Floyd County, Ky., residents' claim that excessive coal dust from a coal-processing facility harmed their health.

The appeals court ruled the policy language was straightforward and rejected NFC's arguments that the exclusion was void because it was against public policy and that a certificate that the insurer filed with a state agency altered the contract.
