Fed. Circ. Sides With Honda In Trademark Dispute

Law360, San Diego (June 13, 2011, 6:35 PM EDT) -- The Federal Circuit on Monday upheld a finding for Honda Motor Co. Ltd. in a dispute stemming from the proposed registration of the mark “dealerdashboard” for providing information on the performance of automotive dealerships.

A three-judge panel of the appeals court determined that the U.S. Patent and Trademark Office’s Trademark Trial and Appeal Board was correct in sustaining Honda’s opposition to the mark proposed by applicant Michael Dalton and refusing to register the mark on grounds that it was merely descriptive.
