Fed. Circ. Revives CamelBak Fight For Lower Duties

Law360, New York (June 16, 2011, 3:38 PM EDT) -- The Federal Circuit on Thursday overturned a U.S. Court of International Trade decision that CamelBak Products LLC's hybrid backpack-water bottle products imported from the Philippines were properly classified as backpacks and therefore correctly liquidated at a 17.8 percent duty rate.

In a split decision, the appeals court found that the CIT had erred in upholding U.S. Customs and Border Protection’s tariff classification of 10 models of hydration packs and hydration systems imported by CamelBak.
