1st Circ. Lets BLAG Join Same-Sex Benefits Suit

Law360, San Diego (June 16, 2011, 10:16 PM EDT) -- The First Circuit on Thursday allowed a congressional body formed to defend the Defense of Marriage Act to intervene in a dispute over health benefits for federal workers in same-sex marriages.

In a brief order, the appeals court permitted the U.S. House of Representative's Bipartisan Legal Advisory Group to take part in the U.S. government’s appeal that initially sought to defend the 1996 law, which defines marriage as between a man and a woman, after a Massachusetts district court ruled it was unconstitutional.
