Insurer Loses 8th Circ. Appeal In Auto Glass Case

Law360, New York (June 17, 2011, 4:05 PM EDT) -- The Eighth Circuit on Friday upheld a $400,000 arbitration award and backed other findings in favor of Alpine Glass Inc., which accused Illinois Farmers Insurance Co. of shortchanging more than 1,000 drivers for car window repairs.

A three-judge panel declined to vacate the arbitration award and affirmed the dismissal of a Farmers' counterclaim that the auto windshield repair company violated a Minnesota anti-incentive statute related to auto glass work. The court also granted Alpine summary judgment on another Farmers' counterclaim for breach of contract.
