Ky. Mining Pollution Suit Filed Too Late: Appeals Court

Law360, New York (June 20, 2011, 6:40 PM EDT) -- A Kentucky appeals court on Friday granted summary judgment to a coal mining company accused of polluting the water supply in Camp Branch, Ky., ruling that residents brought their claims after the expiration of the statute of limitations.

The suit was filed in 2003 by eight residents who alleged that Golden Oak Mining Co. had polluted their well water through mining activities carried out between 1993 and 1997.
