Splenda Maker Tastes Defeat On Injunction Bid

Law360 (May 22, 2007, 12:00 AM EDT) -- A district court judge delivered some not-so-sweet news to McNeil Nutritionals LLC on Monday, after it denied the Splenda-maker’s preliminary injunction to block the packaging of rival Heartland Sweetener’s sugarless sweetener product.

The order was handed down in a case between McNeil and Heartland over the trade dress of Heartland’s products. McNeil sued the company in December 2006, alleging that Heartland’s packaging of the store-brand products was “confusingly similar” to the Splenda trade dress.
