Supreme Court Reins In U.S. Patent Law

Law360 (May 22, 2007, 12:00 AM EDT) -- The increasing globalization of commerce has created tension with the United States patent laws, which in general have an effect only within the borders of the United States.

As a result, the courts have faced more and more cases where the United States patent laws—in particular, 35 U.S.C. § 271(f), which deals with situations where components are created in the United States and then shipped abroad for combination—are being asserted against acts that take place partially or wholly outside the United States.
