Enviros Can Challenge $4M Arch Coal Settlement: Judge

Law360, New York (June 23, 2011, 12:36 PM EDT) -- A West Virginia federal judge on Wednesday allowed three conservation groups to intervene in the U.S. government’s Clean Water Act suit against Arch Coal Inc. and its affiliates, agreeing to hear their challenge to a proposed $4 million consent decree.

U.S. District Judge John T. Copenhaver Jr. ruled that the Sierra Club, the Ohio Valley Environmental Coalition Inc. and the West Virginia Highlands Conservancy Inc. were free to debate the decree’s treatment measures for selenium pollution and its civil penalty for the coal companies' selenium violations....
