Keeping An Eye On Subpoena Compliance

Law360, New York (June 24, 2011, 5:19 PM EDT) -- This year marks the 25th year since Congress enacted the Electronic Communications Privacy Act of 1986 (“ECPA”), 18 U.S.C. § 2510 et seq. The ECPA includes the Wiretap Act, which governs the interception of wire, oral and electronic communications; and the Stored Communications Act (“SCA”), which applies to stored wire and electronic communications. Since its enactment, advancements in digital technology and the volume of information subject to the ECPA’s provisions have grown dramatically. So too have law enforcement’s requests for disclosure of electronic information.
