1st Circ. Backs Short-Staffed NLRB On Disclosure Rule

Law360, New York (June 23, 2011, 4:31 PM EDT) -- The First Circuit on Wednesday upheld a decision originally reached by just two members of the National Labor Relations Board, affirming that temp agency Northeastern Land Services Ltd. maintained an overly broad confidentiality clause in its employment contracts.

This is the second time the First Circuit has issued such a ruling against Northeastern, which appealed the original decision to the U.S. Supreme Court.

Without addressing the merits, the Supreme Court remanded the case in June 2010 in light of its decision in New Process Steel LP...
