Independence Air Triumphs In Amputee's Liability Suit

Law360, New York (June 24, 2011, 1:18 PM EDT) -- A Pennsylvania federal jury sided with Independence Air Inc. on Thursday in a suit brought by a one-legged man who fell off a plane's staircase, nearly a year after the Third Circuit made a precedential ruling that snatched away Independence's initial win.

Plainitff Joseph Elassaad had argued that the steps were defectively designed and that Independence Air staff failed to offer him assistance as required under state law, but the jury ultimately found that the airline was not to blame for Elassaad's fall.
