Philip Morris To Sue Australia Over Packaging Laws

Law360, New York (June 27, 2011, 7:12 PM EDT) -- Philip Morris Asia Ltd. on Monday threatened to sue the Australian government for billions of dollars over plans to introduce plain packaging for tobacco products, saying the proposal violates the country's Bilateral Investment Treaty with Hong Kong.

The Hong Kong-based company, which owns Australian affiliate Philip Morris Ltd., said it has served a notice of claim on the Australian government, stating its intention to pursue legal action over the policy which would require that cigarettes be packaged without logos or different colorings.
