Heartland Atty Dodges Securities Fraud Claims

Law360, New York (June 27, 2011, 5:26 PM EDT) -- A federal judge in Kentucky ruled Monday that an attorney who helped prepare private placement documents for bankrupt oil and gas driller Heartland Resources Inc. could not be held liable for a $14 million fraud.

U.S. District Judge Joseph H. McKinley Jr. granted attorney Hunter Durham’s motions for summary judgment, saying that he could not be considered an agent in the fraud under Kentucky securities law despite the plaintiffs’ arguments otherwise.
