6th Circ. Defines EEOC Charge, Revives CSX Bias Suit

Law360, New York (June 28, 2011, 7:17 PM EDT) -- The Sixth Circuit on Tuesday defined what constitutes the filing of a charge in an employment discrimination suit, reviving a complaint by a CSX Transportation Co. Inc. worker who claimed the company created a sexually hostile workplace.

While ruling that a Tennessee federal judge incorrectly granted summary judgment to CSX on sex discrimination claims on the grounds that plaintiff Stephanie Williams' filings with the U.S. Equal Employment Opportunity Commission did not constitute a charge, the Sixth Circuit affirmed the lower court's ruling in favor of CSX...
