1st Circ. Revives Verizon Suit Over Union CBA Row

Law360, New York (June 30, 2011, 10:45 PM EDT) -- A federal appeals court on Thursday revived Verizon New England Inc.'s lawsuit in Massachusetts claiming the International Brotherhood of Electrical Workers union violated a collective bargaining agreement by picketing and refusing to transport tools.

The U.S. Court of Appeals for the First Circuit reversed the district court's ruling that Verizon could not sue Local 2322 for declaratory relief, but it affirmed the lower court's decision not to issue an order barring the union from striking or picketing in the future.
