Counterclaims To Stay In Wis. Superfund Fight

Law360, New York (July 6, 2011, 1:39 PM EDT) -- A Wisconsin federal judge on Tuesday denied a request by the U.S. and Wisconsin to drop or transfer a slew of cross-claims and counterclaims from litigation over how to pay for remediation of the nation’s largest Superfund site.

U.S. District Judge William Griesbach said that while he was sympathetic to the governments’ desire to mitigate the “cringe-inducing” fees that have arisen in the case, he remained unconvinced that dismissing the claims would make the matter easier to manage.
