Criteria In Design Patent Infringement Determination

Law360, New York (July 15, 2011, 1:22 PM EDT) -- Since 2003, the People’s Republic of China (PRC) has seen a great deal of litigation focused on patent infringement. This increase in activity can be linked back to a certain event in particular. The trigger for this litigation can be traced back to Honda Motor Co. Ltd. accusing local competitor Shijiazhuang Shuanghuan Automobile Co. Ltd. of copying the design of its CR-V; noting the clear similarity in outer design with Shuanghuan's S-RV.
