IBM Fails To Cut Data Storage Patent From 337 Case

Law360, New York (July 12, 2011, 4:47 PM EDT) -- A U.S. International Trade Commission judge ruled Monday that too many factual questions remained to drop one of two data storage system patents from a Section 337 case against IBM Corp. and BDT AG.

ITC Administrative Law Judge Charles E. Bullock denied the respondents' motions for partial summary determination on the issue of whether their accused products infringed 16 claims of U.S. Patent Number 6,353,581.
