8th Circ. Tells Schwan's To Comply With EEOC Subpoena

Law360, New York (July 13, 2011, 5:36 PM EDT) -- The Eighth Circuit on Wednesday upheld a lower court order enforcing an administrative subpoena issued by the U.S. Equal Employment Opportunity Commission in a sex discrimination probe of Schwan Food Co.'s home delivery unit.

The appeals court ruled that the agency's request for information was relevant to a valid claim of discrimination, and that even if former Schwan's Home Service Inc. employee Kim Milliren's systemic sex discrimination claim were invalid, the information sought in the subpoena was nonetheless within the scope of the EEOC’s investigative authority....
