8th Circ. Upholds Injunction On Ark. Power Plant

Law360, Washington (July 14, 2011, 5:23 PM EDT) -- The Eighth Circuit on Thursday affirmed an Arkansas federal court's limited injunction in two related environmental suits seeking to block Southwestern Electric Power Co. from continuing construction on a $1.7 billion coal-fired power plant in the state.

The lawsuit centers on the planned John W. Turk Jr. Power Plant in southwest Arkansas. The plant was approved by the U.S. Army Corps of Engineers, but its construction was challenged by the Sierra Club and other groups who claim SWEPCO, the Army, and the U.S. Fish and Wildlife...
