NLRB Favors Truck Maker Peterbilt In Lockout Fight

Law360, New York (July 19, 2011, 5:46 PM EDT) -- The National Labor Relations Board ruled Friday that Paccar Inc. unit Peterbilt Motors Co.'s refusal to hand over wage and benefits information requested by the United Auto Workers did not make the truck manufacturer's lockout of workers at a Nashville, Tenn., plant unlawful.

Reversing a finding by an administrative law judge, the NLRB found that while Peterbilt's decision to withhold the data was a violation of the National Labor Relations Act, its refusal did not materially affect the stalled negotiations, so the violation would not convert...
