Merck Fails To Nix Femina Birth Control Patent In ITC Row

Law360, New York (July 20, 2011, 1:36 PM EDT) -- Femina Pharma Inc. announced Wednesday that a U.S. International Trade Commission judge had rejected NuvaRing maker Merck & Co. Inc.'s claims that a Femina patent related to vaginal ring birth control devices was invalid.

The administrative law judge denied an attempt in June by Merck — joined by subsidiaries Schering Plough Corp., Organon U.S.A. Inc., and N.V. Organon, as well as drugstore chains CVS Pharmacy, Inc., Wal-Mart Stores, Inc. and Walgreen Co. — to invalidate U.S. Patent Number 6,086,909, advancing the dispute toward an October hearing, according...
