Massey Asks Panel To Bar Evidence In Slurry Case

Law360, New York (July 22, 2011, 4:33 PM EDT) -- Massey Energy Co. on Friday was reportedly seeking to bar evidence tied to the April 2010 Upper Big Branch Mine explosion from being used in a West Virginia mass tort alleging a Massey unit tainted groundwater with coal slurry.

Al Sebok of Jackson Kelly PLLC, who represents Massey, said the April 2010 explosion was not relevant to the suit filed by more than 700 residents before West Virginia's Mass Litigation Panel, the Associated Press reported Friday. Massey is also seeking to bar evidence related to litigation...
