DC Circ. Nixes Protest Of EPA Ship Discharge Permit

Law360, New York (July 26, 2011, 1:35 PM EDT) -- The D.C. Circuit on Friday rejected the shipping industry's protest over the U.S. Environmental Protection Agency's inclusion of varying state-specific standards in a nationwide permit regulating ship ballast water discharge, which can introduce invasive species to U.S. waterways.

Trade groups including the Lake Carriers' Association and The American Waterways Operators argued that complying with standards that differ by state would prove burdensome to vessels traveling across state borders.
