CIT Nixes Chemical Co.'s Drawback Suit

Law360, New York (August 2, 2011, 7:19 PM EDT) -- The U.S. Court of International trade on Tuesday dismissed chemical company Isaac Industries Inc.'s lawsuit challenging U.S. Customs and Border Protection's denial of its drawback claims for duties on polyether polyol that it imported and then re-exported.

CIT Judge Donald C. Pogue granted summary judgment to the government and dismissed the suit, finding that Customs had properly denied the company's drawback requests for refunds of duties on the re-exported polyether polyol and protests.
