Third Circuit Knocks Down AARP Challenge To EEOC

Law360 (June 6, 2007, 12:00 AM EDT) -- The U.S. Court of Appeals for the Third Circuit has rejected the American Association of Retired Persons' challenge to an Equal Employment Opportunity Commission rule that would enable employers to slash health benefits for older retirees without being guilty of age discrimination.

On Monday, the Third Circuit upheld the district court's ruling in favor of the EEOC, handing the agency a victory in its long-standing battle against the AARP.
