8th Circ. Allows Interrogatories In AMCO Coverage Suit

Law360, New York (August 10, 2011, 6:06 PM EDT) -- The Eighth Circuit ruled Wednesday that sworn interrogatories can be used to make coverage determinations, but still reversed AMCO Insurance Co.'s win in a fight with Inspired Technologies Inc. over coverage of a false advertising suit.

While no cases in Minnesota, where the underlying federal suit was filed, have authorized using interrogatory answers as "actual facts," the Eighth Circuit ruled that interrogatory answers are sworn statements and may be used to determine whether insurers are obligated to cover their insured.
