Judge Trims Coverage Suit Over Lubrizol Cleanup Costs

Law360, New York (August 11, 2011, 3:19 PM EDT) -- An Ohio federal judge dismissed a bad faith claim against Arrowood Indemnity Co. on Wednesday, a victory in the insurer's fight to avoid indemnifying specialty chemicals company Lubrizol Corp. for the cleanup of a Texas Superfund site.

Lubrizol is on the hook for the cleanup of the Patrick Bayou, which is adjacent to its Deer Park, Texas, facility. The company has paid $2.9 million for remediation since 2002 when the bayou was named a Superfund site.
