EPA Tells DC Circ. Smog Rules Will Be Ready 'Shortly'

Law360, New York (August 12, 2011, 7:16 PM EDT) -- The U.S. Environmental Protection Agency told the D.C. Circuit on Friday that it would finalize new standards for ozone emissions “shortly,” after environmental groups pressured the court earlier in the week to force the agency to do so immediately.

The EPA did not offer a timeline for when it would finalize the strengthening of a 2008 Clean Air Act standard for ground-level ozone. The agency first unveiled the tighter standards in January 2010, proposing ozone limits that would set a primary standard of 60 to 70...
