Union Pacific, BNSF Slam 'Incoherent' Antitrust Suit

Law360, New York (August 16, 2011, 8:07 PM EDT) -- Union Pacific Railroad Co. and BNSF Railway Co. fired back at Oxbow Carbon LLC on Monday, claiming the coal shipper’s “incoherent” antitrust claims against them did not plausibly demonstrate that they fixed shipping prices. 

Union Pacific and BNSF each filed motions to dismiss in Washington federal court, arguing Oxbow’s suit accusing the two rail companies of conspiring to monopolize the coal shipping industry failed to show any factual allegations that the two companies engaged in a price-fixing fuel scheme and operated as an illegal monopoly....
